SplashSend is fully compliant with the CAN-SPAM Act (Controlling the Assault of Non-Solicited Pornography And Marketing Act of 2003), the primary law governing commercial email in the United States.
The CAN-SPAM Act sets rules for commercial email, establishes requirements for commercial messages, gives recipients the right to stop receiving emails, and spells out penalties for violations. It applies to all commercial messages — any electronic mail message where the primary purpose is the commercial advertisement or promotion of a product or service.
Every email we send on your behalf clearly identifies the sender. The “From,” “To,” and “Reply-To” fields accurately reflect who is sending the message and how to reach them.
Subject lines must accurately reflect the content of the email. SplashSend’s AI subject line suggestions are designed to be clear and relevant, but you remain responsible for the final subject line you choose to send.
When required, emails are identified as advertisements. Senders can include appropriate disclosures in their email content.
Every email includes a valid physical postal address. This is collected when you set up your account and automatically included in the footer of every email we send.
Every email includes a clear, easy-to-find unsubscribe link. We also include List-Unsubscribe headers so that email clients like Gmail and Outlook can offer a one-click unsubscribe button directly in the inbox.
When someone unsubscribes, we process it immediately. The CAN-SPAM Act requires opt-outs to be honoured within 10 business days — we do it in seconds.
We automatically suppress contacts whose emails bounce or who report our emails as spam. This prevents continued sending to invalid or unwilling recipients.
Each separate email in violation of the CAN-SPAM Act can carry a penalty of up to $53,088 (the 2026 maximum — the figure is adjusted for inflation each year). The FTC (Federal Trade Commission) is responsible for enforcement. SplashSend’s built-in compliance features help protect you from accidental violations.
