SplashSend is fully compliant with Canada’s Anti-Spam Legislation (CASL, S.C. 2010, c. 23), one of the strictest anti-spam laws in the world.
CASL is a Canadian law that protects consumers and businesses from the misuse of digital technology, including spam and other electronic threats. It applies to all commercial electronic messages (CEMs) sent to or from Canada, regardless of where the sender is located.
CASL requires express, opt-in consent before sending commercial electronic messages. Unlike some other regulations, consent cannot be assumed from a pre-existing business relationship alone. SplashSend only sends emails to contacts who have explicitly opted in — whether through a signup form, an API integration, or a Shopify marketing consent sync.
We maintain detailed records of when and how consent was obtained for every contact. Each record includes a consent timestamp, the method of consent (e.g. signup form, import, Shopify sync), and where available, the IP address at the time of consent. These records serve as proof of compliance.
Every email clearly identifies who is sending it. The sender name and email address appear in the “From” header, and a valid physical postal address is included in the footer of every email.
Every email includes a functional unsubscribe link that works immediately and does not expire. CASL requires the mechanism to remain active for at least 60 days after sending — our unsubscribe links work indefinitely.
CASL requires unsubscribe requests to be processed within 10 business days. SplashSend processes every unsubscribe instantly — the moment someone clicks the link, their status is updated and no further emails are sent.
Consent to receive emails is given by actively submitting the signup form — SplashSend does not use pre-checked consent boxes. Email preference categories default to all enabled, allowing subscribers to deselect any they don’t want.
