By accessing or using SplashSend, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using the service.
SplashSend grants you a limited, non-exclusive, non-transferable licence to use the service for your personal or business email marketing needs, subject to these terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use.
You agree not to use SplashSend to send unsolicited emails (spam), distribute malware, violate any applicable laws, or engage in any activity that could harm the service or other users.
All emails sent through SplashSend must comply with applicable anti-spam legislation including CAN-SPAM, GDPR, and CASL. You must have valid consent from recipients and include an unsubscribe mechanism in every email.
Paid plans are billed in advance on a monthly basis. You agree to pay all applicable fees. We reserve the right to change our pricing with 30 days’ notice.
You retain all rights to your data. SplashSend does not claim ownership of any content you upload or send through our service. We process your data only as necessary to provide the service.
We strive to maintain high availability of the service but do not guarantee uninterrupted access. We are not liable for any downtime or service interruptions outside of our reasonable control.
You may cancel your account at any time from your account settings. We reserve the right to suspend or terminate your account immediately if you breach these terms, including the acceptable use or email sending guidelines. Upon termination, your data will be retained for 30 days before permanent deletion, after which it cannot be recovered.
SplashSend shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service.
We reserve the right to modify these terms at any time. Continued use of the service after changes constitutes acceptance of the new terms.
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
